I went to install my new Naichspeed 3" CAI today, and I ran into some trouble. Is the filter supposed to be positioned where this picture shows it?

I had a very hard time getting things to line up at all, and this was the best I could do. If this looks wrong, I can try again. After I put the fender liner back in, it seemed that it was being pushed towards the tire a bit by the CAI, which doesn't seem right to me. I'd appreciate any input.
Oh, and for reference, I didn't tighten things down until I had all the pipes together, and I slid the battery as far forward as possible.
